Read the employer policy
Look for pre-employment testing, random testing, post-accident testing, impairment standards, prescription-drug disclosure and accommodation procedures. Keep the version that applied when a decision was made.
Identify federal or safety-sensitive work
Transportation, federal contracts, healthcare, law enforcement and other regulated positions may be subject to rules that differ from ordinary state employment protections.
Separate off-duty use from workplace impairment
Many disputes turn on whether an employer is addressing lawful off-duty status, a test result or observed impairment. Document facts carefully rather than assuming those concepts are legally identical.
Prepare for an accommodation conversation
Where applicable, focus on job functions, timing, safety and state law. A clinician may be able to document a medical condition without revealing more information than necessary.
